If Jetboat Curaçao is later incorporated as a separate company and becomes the controller of your data, we will update this Privacy Policy and inform subscribers where required.

2. What personal data do we collect?

When you sign up for Jetboat Curaçao updates, we may collect:

• Your email address;
• Your first name, if you choose to provide it;
• Your signup preferences and consent status;
• The date and time of your signup;
• The page or URL through which you signed up;
• Your timezone; and
• Technical information processed when you visit the website, such as your IP address, browser or device information, referring page, security logs and necessary cookie identifiers.

If you consent to analytics cookies, we also collect or generate website-usage information through Google Analytics 4 and Microsoft Clarity. This may include:

• Pages visited, entry and exit pages, referring URLs, approximate location, date and time of visits, and time spent on pages;
• Browser, device type, operating system, screen size and language;
• Interactions such as clicks, taps, scrolling, mouse movements, navigation, video engagement, outbound-link clicks and form interactions;
• Pseudonymous cookie and session identifiers; and
• Visual reconstructions of browsing sessions and aggregated heatmaps generated by Microsoft Clarity.

Microsoft Clarity session replays are reconstructions based on page content and interactions, rather than conventional video recordings. Text entered into input fields is masked by Clarity and is not visible in session replays. We do not intentionally send names, email addresses or other directly identifying form contents to Google Analytics or Microsoft Clarity.

Google Analytics uses an IP address temporarily to derive approximate geographic information. Google states that individual IP addresses are not logged or stored in Google Analytics. Approximate location information may nevertheless be included in analytics reports.

When we send emails, the platform may also process delivery and engagement information, such as whether an email was delivered or bounced, whether you unsubscribed and, depending on our settings, whether an email was opened or a link was clicked.

If you contact us, we may also process the contents of your message and any other information you choose to provide.

Please do not provide information that is not needed for your signup or enquiry.

3. Why do we use your data?

We use your personal data for the following purposes:

You may withdraw your consent at any time. Withdrawing consent does not affect the lawfulness of processing that took place before the withdrawal.

4. Email communications

We will only send promotional email updates after you have actively signed up. Every marketing email will include an unsubscribe link. You can also unsubscribe by emailing [email protected].

We may send information about:

• Planned launch dates and operational updates;
• When tickets become available;
• Access to tickets for discounted opening weeks;
• The Jetboat Curaçao experience; and
• Occasional news, offers and promotions relating to Jetboat Curaçao.

We will not use your signup to promote unrelated businesses without obtaining any further consent required by law.

We may use email delivery and engagement information to maintain the mailing list, troubleshoot delivery problems and understand how our communications perform. Where consent is legally required for optional engagement tracking, we will not use that tracking without consent.

5. Cookies policy

The website is built and hosted using Content Creator Machine, which uses HighLevel technology. The platform may use cookies or similar technologies that are necessary to display, secure and operate the website and its forms.

We also use the following optional analytics services:

Google Analytics and Microsoft Clarity are optional analytics technologies. We only activate them after you consent through the cookie banner. You can refuse them without losing access to the website. The legal basis for the related processing of personal data is your consent.

You can change your preferences or withdraw consent at any time through “Cookie settings” on the website. Withdrawal does not affect the lawfulness of processing before withdrawal. The cookie settings list individual cookies, their purposes, domains and lifetimes. You can also block or remove cookies through your browser settings, although blocking necessary cookies may affect website functionality.

Salem Solutions has not configured Meta Pixel or other advertising tracking on the website. We do not currently use advertising cookies to build profiles of visitors.

We use Google Analytics and Microsoft Clarity for audience measurement, website optimisation and troubleshooting, not for personalised advertising. If we later introduce Meta Pixel, advertising personalisation or other materially different tracking, we will update this Privacy Policy and request any consent required by law before activating it.

6. Who receives your data?

We do not sell or rent your personal data.

We share data only when necessary with:

• Content Creator Machine, which provides the website, forms, customer relationship management and email-marketing environment;
• HighLevel LLC and LeadConnector LLC, whose technology supports Content Creator Machine and may process data on behalf of the platform provider;
• Google, which provides Google Analytics 4 and processes website-usage and analytics information;
• Microsoft, which provides Microsoft Clarity and processes website-interaction information, heatmaps and session-replay data;
• Technical, hosting, email-delivery, security and professional service providers that help us operate the website and mailing list; and
• Courts, regulators, public authorities or advisers where disclosure is legally required or necessary to establish, exercise or defend legal claims.

These providers may use their own approved subprocessors. They may only process personal data for the relevant service or as otherwise permitted by applicable law.

If a separately incorporated Jetboat Curaçao business later takes over the project, subscriber data may be transferred to that company as part of the transition. Before that company becomes the controller, we will update the privacy information and notify subscribers where required. The data may not be used for an incompatible purpose without a valid legal basis.

7. International data transfers

Some of our technology providers or their subprocessors, including providers supporting HighLevel, Google Analytics and Microsoft Clarity, may process personal data outside the European Economic Area, including in the United States.

Where required, such transfers are protected through a valid transfer mechanism, such as an adequacy decision, participation in the EU–US Data Privacy Framework, the European Commission's Standard Contractual Clauses, and any additional safeguards required by law.

8. How long do we keep your data?

We retain your contact and marketing data until you unsubscribe, withdraw your consent, the Jetboat Curaçao mailing list is discontinued, or the data is no longer reasonably necessary for the purposes described in this policy. We review the mailing list periodically and delete or anonymise personal data when it is no longer reasonably necessary.

After you unsubscribe, we may retain limited information, such as your email address, unsubscribe status and consent history, for as long as reasonably necessary to ensure that we honour your request and can demonstrate compliance with applicable law.

For Google Analytics 4, user-level and event-level analytics data is retained for no longer than 14 months, subject to the retention settings applied to the Analytics property. Standard aggregated reports may remain available for longer because Google's event-data retention control does not apply to those aggregated reports.

Microsoft Clarity generally retains session-replay data for 30 days. Click and heatmap data, and sessions that are labelled or saved as favourites, may be retained for up to 9 months. Provider-side backup deletion may take place in accordance with Microsoft's retention processes.

Analytics cookies and pseudonymous identifiers remain on a device for the period shown in the cookie settings or until they expire or are removed. Their lifetime may be refreshed when you return to the website, depending on the provider's settings and your consent.

Technical and security records are retained only for as long as reasonably necessary for website operation, security, troubleshooting and legal compliance. If a longer retention period is required by law or is necessary in connection with a dispute, we may retain relevant information for that period.

9. How do we protect your data?

We take reasonable technical and organisational measures to protect personal data against loss, misuse, unauthorised access, alteration and disclosure. Access is limited to people and service providers who need the data for the purposes described in this policy.

No method of online transmission or storage is completely secure. We therefore cannot guarantee absolute security.

10. Your privacy rights

Under the GDPR, you have the right to:

• Ask whether we process your personal data and receive a copy;
• Correct incomplete or inaccurate data;
• Request deletion of your data;
• Restrict how we use your data;
• Receive data you provided in a portable format;
• Object to processing based on legitimate interests or for direct marketing;
• Withdraw consent at any time; and
• Lodge a complaint with a competent data-protection authority.

You can exercise these rights by emailing [email protected]. We may need to verify your identity before completing a request. We will respond without undue delay and normally within one month. Where permitted by law, we may extend this period by up to two additional months if a request is complex or if we receive several requests. If an extension is necessary, we will inform you within the first month.

Because Salem Solutions is established in the Netherlands, you may lodge a complaint with the Dutch Data Protection Authority, the Autoriteit Persoonsgegevens, through autoriteitpersoonsgegevens.nl.

11. Children

The email signup is not intended to collect personal data directly from children under 16. If you believe a child has submitted personal data without the required permission, please contact us so that we can review and, where appropriate, delete it.

12. Automated decision-making

We do not use the data collected through the coming-soon signup to make decisions based solely on automated processing that produce legal or similarly significant effects.

13. Changes to this Privacy Policy

We may update this Privacy Policy when our website, services, providers or legal obligations change. The latest version will always be published on this page with its effective date. If a change materially affects how we use existing subscriber data, we will provide additional notice or request new consent where required.
